Article 2 - General
2.1 These general terms and conditions apply to all offers from SPORTSFRAMEONE.
2.2 By placing an order, you agree to the deliveryand payment terms. These terms and conditions take precedence over the customer's general terms and conditions.
2.3 Unless otherwise agreed in writing, SPORTSFRAMEONE does not recognize the general or specific terms and conditions or stipulations of third parties.
2.4 SPORTSFRAMEONE guarantees that the delivered product complies with the agreement and meets the specifications stated in the offer.
Article 3 - Delivery
3.1 Delivery is subject to availability.
3.2 The products are delivered by a courier service of SPORTSFRAMEONE's choice. SPORTSFRAMEONE will fulfill orders within a maximum of 30 days, in accordance with the rules of the Distance Selling Act.
If this is not possible (for example because the ordered product is out of stock or no longer available, or for other reasons causing delay or partial fulfillment), the consumer will be informed within 1 month after placing the order, and in that case the consumer has the right to cancel the order free of charge and without notice of default.
3.3 SPORTSFRAMEONE's delivery obligation is considered fulfilled as soon as the goods delivered by SPORTSFRAMEONE have been offered to the customer at the specified location and address. For home delivery, the carrier's report stating that acceptance has been refused serves as full proof of the offer to deliver.
3.4 The address provided by the customer to SPORTSFRAMEONE serves as the place of delivery. The customer is responsible for any costs resulting from the impossibility of personal delivery at the specified address.
3.5 All terms stated in the webshop are indicative. Therefore, no rights can be derived from the stated periods.
Article 4 - Prices
4.1 All prices stated always include VAT and all other taxes to be borne by the customer. If transport, reservation or administration costs are charged, this will be stated separately.
4.2 SPORTSFRAMEONE reserves the right to change the prices of the products at any time (except for orders already placed or in advance).
Article 5 - Reflection period - Right of withdrawal
5.1 Bespoke items, including but not limited to personalized products, special adjustments and goods made to customer request, are not covered by our standard returns policy.
5.2 The reason for not accepting returns on bespoke items is that these products have been specifically manufactured to the customer's exact specifications and requirements and may therefore not be suitable for resale to other customers.
5.3 We encourage our customers to consider and confirm their choices extremely carefully when ordering bespoke items. We are always ready to answer any questions and provide clarification before the order is placed, to ensure that your purchase fully meets your expectations.
5.4 In the event that a custom made item arrives defective or damaged, we will do our utmost to resolve the problem by repair, replacement or refund depending on the nature of the defect. In that case, the customer must immediately contact our customer service and provide all necessary information for further processing.
5.5 For all other products that are not custom-made and are covered by our standard returns policy, please refer to the relevant sections of our returns policy for instructions regarding product returns and refunds.
This numbering clearly identifies the different points in Section 5 for your returns policy.
Article 6 - Retention of title
6.1 The ownership of all goods sold and delivered by SPORTSFRAMEONE to the customer remains with SPORTSFRAMEONE as long as the customer has not paid SPORTSFRAMEONE's claims under the agreement or previous or subsequent similar agreements, as long as the customer has completed the work performed or to be performed under has not yet fulfilled these or similar agreements and as long as the customer has not yet paid SPORTSFRAMEONE's claims due to failure to comply with such obligations, including claims for fines, interest and costs, as referred to in Article 3:92 of the Dutch Civil Code.
Article 7 - Warranty and conformity
7.1 SPORTSFRAMEONE guarantees that the products comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability, and the legal provisions and/or government regulations applicable on the date of conclusion of the agreement. . If expressly agreed, SPORTSFRAMEONE also guarantees that the product is suitable for other than normal use.
7.2 A warranty provided by SPORTSFRAMEONE, the manufacturer or the importer does not affect the legal rights and claims that the customer can assert against SPORTSFRAMEONE under the agreement.
7.3 Any defects or incorrectly delivered products must be reported in writing to SPORTSFRAMEONE within 7 days of delivery. Products must be returned in the original packaging and in new condition.
7.4 The warranty period of SPORTSFRAMEONE corresponds to the manufacturer's warranty period. However, SPORTSFRAMEONE is never responsible for the ultimate suitability of the products for each individual use by the customer, nor for any advice regarding the use or application of the products.
7.5 The customer is obliged to check the delivered products immediately upon receipt. If it turns out that the delivered product is incorrect, defective or incomplete, the customer must immediately report these defects in writing to SPORTSFRAMEONE (before returning the products to SPORTSFRAMEONE). Any defects or incorrectly delivered goods must and can be reported to SPORTSFRAMEONE in writing no later than 2 months after delivery. Products must be returned in the original packaging (including accessories and associated documentation) and in new condition. Use of the products after discovery of defects, damage caused after discovery of defects, tax and/or resale after discovery of defects, completely voids this right to complaint and return.
7.6 If complaints from the customer are found to be justified by SPORTSFRAMEONE, SPORTSFRAMEONE will, at its own discretion, replace the delivered products free of charge or make a written arrangement with the customer for compensation, whereby SPORTSFRAMEONE's liability and therefore the amount of compensation is always limited to maximum the invoice amount of the relevant products, or (at SPORTSFRAMEONE's option) up to the maximum amount covered in that case by SPORTSFRAMEONE's liability insurance. Any liability of SPORTSFRAMEONE for any other form of damage is excluded, including additional compensation in any form, compensation for indirect damage or consequential damage, or damage resulting from lost profits.
7.7 SPORTSFRAMEONE is not liable for damage caused by intent or deliberate recklessness of non-managerial staff.
7.8 This warranty does not apply if: A) and as long as the customer remains in default towards SPORTSFRAMEONE; B) the customer has repaired and/or edited the delivered products himself or has had them repaired and/or edited by third parties; C) the delivered products have been exposed to abnormal conditions or have otherwise been treated carelessly or are contrary to the instructions of SPORTSFRAMEONE and/or on the packaging; D) the defect is wholly or partly the result of regulations that the government has imposed or will impose with regard to the nature or quality of the materials used.
Article 8 - Orders/communication
8.1 SPORTSFRAMEONE is not liable for misunderstandings, damage, delays or unclear communication of orders and notices as a result of the use of the Internet or any other means of communication in the communication between the customer and SPORTSFRAMEONE, or between SPORTSFRAMEONE and third parties, insofar as this relates to the relationship between the customer and SPORTSFRAMEONE.
Article 9 - Force majeure
9.1 Despite the other rights to which it is entitled, in the event of force majeure, SPORTSFRAMEONE has the right, at its own discretion, to suspend the execution of the order or to terminate the agreement without the intervention of the court, by notifying the supplier in writing. to inform the customer, without SPORTSFRAMEONE being obliged to pay any compensation, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness.
